Unclaimed Funds

Unclaimed Funds

One of the many responsibilities of the Hillsborough County Clerk of Court and Comptroller is that of custodian of funds from Hillsborough County circuit and county court cases, along with funds from the Hillsborough County Board of County Commissioners (BOCC). Unclaimed funds are outstanding checks issued by the Clerk and the BOCC that have not cleared the bank or deposited funds which the owner has not claimed.
Clerk unclaimed funds
Unclaimed funds held by the Clerk of Court are outstanding checks that have not cleared the bank or deposited funds not claimed by the owner. If a check was lost or destroyed, it may be replaced. Prior to replacing a check, we will verify that the funds have not been paid. There is a 30-day waiting period after a check has been issued to request a replacement. If the funds have been paid from the bank, the check will not be replaced. Replacement checks can only sent to the original owner of the funds. Checks dated more than 6 months old are no longer payable and must be replaced in order to be cashed.

If funds remain unclaimed after one year, most are submitted to the State of Florida Department of Revenue in accordance with FS 717 [external link], Disposition of Unclaimed Property.
